Terms of Service
1. Acceptance of Terms
By accessing PayFlorida.com or purchasing any product, feed, or sample package, you agree to these Terms of Service ("Terms"). If you are accepting on behalf of a company, you represent that you have authority to bind that entity.
2. Service Scope
PayFlorida.com provides business data intelligence, public record aggregation, enrichment analytics, and related research packages focused on Florida tax deed surplus and associated publicly available records. Deliverables may include CSV/JSON feeds, dossier packages, evidence indexes, and subscriber access tools.
3. Important Legal Disclaimer
PayFlorida.com is a commercial data provider and does not provide legal, financial, or real estate advice. Subscribers are responsible for compliance with local, state, and federal outreach regulations (including TCPA and FDCPA).
You are solely responsible for how you use the data, including any outreach, claim filing, litigation strategy, or consumer communications. Always independently verify ownership, balances, liens, deadlines, and applicable law before taking action.
4. Data Provider Status & Subscriber Compliance
Data Provider Status
Independent Information Provider: PayFlorida operates strictly as a public records data compiler and analytics provider. PayFlorida is not a telemarketing agency, law firm, debt collector, or broker. All data, skip-traced numbers, and public clerk records are provided “as-is” for legal research and informational purposes only.
Subscriber Compliance & SAN Requirement
TCPA & DNC Compliance Responsibility: Subscriber acknowledges that any phone, email, or direct outreach initiated using PayFlorida data must comply with all applicable local, state, and federal regulations, including the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), and National Do Not Call (DNC) Registry rules. Subscriber agrees that they are the “caller/initiator” under the law and are solely responsible for obtaining and maintaining their own FTC Subscription Account Number (SAN) and honoring all opt-out requests.
Indemnification
Hold Harmless: Subscriber agrees to defend, indemnify, and hold harmless PayFlorida, its parent company, officers, and affiliates against any and all claims, liabilities, damages, regulatory fines, legal fees, or litigation costs arising out of Subscriber’s use of PayFlorida data, telemarketing activities, auto-dialer usage, or alleged violations of the TCPA, DNC registry, or state privacy laws.
5. Subscription & Billing Terms
- Recovery Pro ($750/month): Billed as a recurring Stripe subscription. On mornings when a file is published, it is released at 7:00 AM ET for active subscribers. A county that did not publish, or a run that did not complete, can mean no new records that morning. Unless canceled, the subscription renews automatically each billing period at the then-current rate.
- Proof Pack ($99 once): Five current Florida cases matched to selected counties and surplus range, with available enrichment and source documents. No renewal. The $99 is credited toward Recovery Pro or Case Credits purchased within 14 days. Requested at /proof-pack. Does not start the monthly feed.
- Case Credits ($99–$199 per accepted case): Paid when the buyer accepts a qualified case that matches saved criteria. Not a percent of recovery. A case cannot be rejected only because the claimant did not answer. Arranged through /case-credits.
- Cancellation: Cancel in the Stripe customer portal from the link on your receipt, or email sales@payflorida.com before the next billing date. No phone call is required. Cancellation stops future charges; it does not entitle you to a refund for the current paid period once data access or delivery has begun.
6. Refund Policy
Because PayFlorida delivers proprietary digital datasets and research packages, digital dataset downloads and subscription feeds are non-refundable once delivered or access has been granted. If a fulfillment failure occurs on our side, contact support within 24 business hours and we will work to complete delivery or provide an equivalent remedy at our discretion.
7. Acceptable Use
- Use data only for lawful business purposes.
- Do not attempt to reverse engineer, resell, republish, or redistribute PayFlorida datasets without prior written consent.
- Do not misuse the service to harass individuals, violate privacy or outreach laws, or circumvent security controls.
- Maintain the confidentiality of any API keys or download links issued to you.
8. Public Record Accuracy & Limitation of Liability
Data is aggregated from public sources and third-party enrichment systems that may contain errors, delays, omissions, or incomplete records. PayFlorida does not warrant that any record is complete, current, or fit for a particular claim outcome.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYFLORIDA AND ITS AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, OR DATA INACCURACIES, ARISING FROM USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO PAYFLORIDA FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE EVENT.
9. Intellectual Property
Site content, packaging formats, schemas, enrichment pipelines, and branding are owned by PayFlorida or its licensors. Purchase grants a limited, non-exclusive, non-transferable license to use delivered datasets for your internal business operations, subject to these Terms.
10. Termination
We may suspend or terminate access for unpaid invoices, abuse, legal risk, or material breach of these Terms. Provisions that by nature should survive termination (including disclaimers, limitations of liability, and IP ownership) will survive.
11. Case Credits addendum
A case is presented against the buyer’s saved criteria. The buyer receives the case summary and objective qualification fields before accepting it. Acceptance is based on whether the record matches the agreed criteria—not whether a claimant later answers or a recovery succeeds.
Allowed rejection reasons we will honor: wrong owner, wrong surplus versus the clerk posting, case older than the stated maximum, contact data fails the agreed check, case misses saved criteria, or the buyer already had the same clerk file. A silent claimant is not a rejection or replacement reason.
If PayFlorida later determines a delivered accepted case was a duplicate of a file the buyer already had from PayFlorida, or was already stale versus the clerk posting at the time of presentation, a replacement case or credit will be issued.
The exact $99 versus $199 price, response window, and the precise fields revealed before versus after acceptance are confirmed in writing before the first credit is issued. This site does not invent those commercial terms.
